General Terms & Conditions for the use of PropertyLinks.ie.

1. Introduction

These Terms & Conditions ("Terms") govern your use of PropertyLinks.ie, operated by Property Links Premier Global Limited ("PropertyLinks", "we", "us", "our").

By accessing or using the website, registering an account, contacting a seller, auctioneer, or developer, or submitting information through the platform, you agree to be bound by these Terms. If you do not agree, you must not use the site.

These Terms apply to all users, including prospective buyers and other individuals browsing or interacting with listings.

2. Definitions

In these conditions the following words and expressions shall have the following meanings:

Auctioneer – registered firm listing property for sale on propertylinks.ie on behalf of the Seller.

Buyer / User – any individual or entity using the site, including prospective purchasers.

Buyer's Solicitor – the firm of lawyers appointed by the Buyer to act in the purchase of the Seller's properties listed for sale in Property Links.

Catalogue – any advertisement, brochure, estimate, price or other publication whether on propertylinks.ie or not.

Data Room – an online repository of property-related documentation.

Developer – a commercial entity involved in the construction, marketing, and/or sale of new homes or properties, listing such properties for sale on PropertyLinks.ie.

Platform – the PropertyLinks.ie website and related digital tools.

Proof Of Funds – documentary evidence of same may be required to include: (i) copy of bank statement in the name of the Buyer, (ii) letter of offer from mortgage lender to the Buyer, (iii) letter of confirmation from solicitors of funds on hand in their client(s) account to the Buyer.

Property Links – Property Links Premier Global Limited, an Irish registered limited liability company which owns and operates the website propertylinks.

Registration Form – page as completed on propertylinks.ie; given at registration stage detailing, amongst other matters, name and contact information.

Seller – the legal or beneficial owner of a listed property.

Seller's Solicitors – the firm of lawyers appointed by the Seller to undertake the conveying of the Seller's properties listed for sale in Property Links.

V.A.T. – Value Added Tax.

3. Nature of Platform

PropertyLinks.ie is a property listing, marketing, and document-sharing platform only.

PropertyLinks does not:

  • Act as an estate agent, auctioneer, broker, or intermediary
  • Represent or advise Buyers or Sellers
  • Verify property information or legal documentation
  • Participate in negotiations or transactions
  • Provide legal, financial, or valuation advice
  • Handle deposits, contracts, or client funds

All property transactions occur exclusively between Buyers, Sellers, Auctioneers, and their respective solicitors.

4. Access to the Site

We may, at our discretion:

  • Restrict or refuse access
  • Suspend or terminate accounts
  • Limit features or functionality

This may occur due to misuse, breach of these Terms, security concerns, AML issues, or suspected unlawful activity.

5. User Registration

Some features require account registration. By registering, you agree to:

  • Provide accurate and complete information
  • Keep login credentials secure
  • Accept responsibility for all activity under your account

You must notify us immediately of any unauthorised access.

6. Property Listings

All Listing Content is provided by Auctioneers or Sellers.

PropertyLinks does not guarantee:

  • Accuracy or completeness
  • Availability of properties
  • Correctness of prices, measurements, BER ratings, or descriptions
  • That listings will remain active

Users acknowledge that:

  • All reliance on Listing Content is at their own risk
  • Independent inspections, surveys, and legal due diligence are essential
  • Professional advice should be obtained before proceeding with any purchase

7. Data Rooms & Legal Documentation

Seller's Solicitors may upload legal documents to a Data Room for Buyer review.

You acknowledge that:

  • Documents are provided solely by Seller's Solicitors
  • Documents may be draft, incomplete, or subject to change
  • PropertyLinks does not review, verify, or warrant any documentation

Access to the Data Room is at your own risk and does not constitute legal advice.

8. Buyer Due Diligence

Buyers are responsible for:

  • Reviewing all documents with their own solicitor
  • Conducting all necessary legal and structural checks
  • Ensuring they understand the property title, planning status, and any restrictions

PropertyLinks plays no role in the conveyancing process.

9. Proof of Funds

Auctioneers or Sellers may request Proof of Funds before granting Data Room access or progressing enquiries.

PropertyLinks does not:

  • Verify Proof of Funds
  • Assess Buyer suitability
  • Influence acceptance or rejection of any Buyer

All decisions rest solely with the Seller or their representatives.

10. Communications

When you contact an Auctioneer or Seller through the Platform:

  • Communications are transmitted directly to that party
  • PropertyLinks does not control or guarantee responses
  • We are not responsible for the content or outcome of communications

Users must not engage in abusive, misleading, or unlawful communications.

11. Transactions & Contracts

PropertyLinks is not involved in any part of the transaction.

A property sale becomes binding only when:

  • Contracts are executed by the Buyer and Seller
  • Deposits are paid directly to the Seller's Solicitor or Auctioneer
  • All legal requirements are satisfied

Failure of a transaction does not give rise to any claim against PropertyLinks.

12. Intellectual Property

All Platform content, branding, design, and functionality are owned by PropertyLinks or licensed to us.

Users may not reproduce, distribute, or commercially exploit any part of the Platform without written consent.

13. Acceptable Use

Users must not:

  • Upload false, misleading, or unlawful information
  • Attempt to access systems or data without authorisation
  • Interfere with Platform security
  • Scrape or harvest data
  • Upload viruses or malicious code

Breach may result in immediate suspension.

14. Disclaimer

To the fullest extent permitted by law:

  • The Platform is provided "as is" and "as available"
  • We make no warranties regarding accuracy, reliability, or availability
  • Use of the Platform is entirely at your own risk

15. Limitation of Liability

PropertyLinks is not liable for:

  • Errors or omissions in listings or documents
  • Failed, delayed, or aborted transactions
  • Financial loss, loss of profits, or loss of opportunity
  • Technical issues, downtime, or data loss
  • Any indirect or consequential damages

16. Indemnity

You agree to indemnify PropertyLinks against any claims arising from:

  • Your use of the Platform
  • Your breach of these Terms
  • Any unlawful or improper conduct

17. Data Protection

We process personal data in accordance with GDPR and Irish data protection law.

Personal data may be used for:

  • Account management
  • Communication with Auctioneers or Sellers
  • AML and fraud prevention
  • Platform security
  • Legal compliance

18. Changes to Terms

We may update these Terms at any time by publishing the revised version on the Platform. Continued use constitutes acceptance of the updated Terms.

19. Governing Law

These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.

Auctioneer/Developer Terms & Conditions

Auctioneer – registered firm listing property for sale on propertylinks.ie on behalf of the Seller.

Developer – a commercial entity involved in the construction, marketing, and/or sale of new homes or properties, listing such properties for sale on PropertyLinks.ie.

Catalogue – any advertisement, brochure, estimate, price or other publication whether on propertylinks.ie or not.

Data Room – the online repository where the Auctioneer/Developer or their solicitors upload legal documents including draft contract, title documents, planning documentation, BER certificates, and other supporting materials.

V.A.T. – Value Added Tax.

Registration Form – page as completed on propertylinks.ie; given at registration stage detailing, amongst other matters, name and contact information.

Proof Of Funds – documentary evidence of same may be required to include: (i) copy of bank statement in the name of the Buyer, (ii) letter of offer from mortgage lender to the Buyer, (iii) letter of confirmation from solicitors of funds on hand in their client(s) account to the Buyer.

Property Links – Property Links Premier Global Limited, an Irish registered limited liability company which owns and operates the website propertylinks.

Book Now – the date at which a property is available for purchase.

Seller – the legal owner or beneficial owner of the property being sold, or where applicable, the Developer selling newly built units.

Seller's Solicitors – the firm of lawyers appointed by the Seller to undertake the conveying of the Seller's properties listed for sale in Property Links.

Proof of Funds – documentation uploaded by a Buyer to prove financial capacity, including bank statements, mortgage approval, or solicitor confirmation.

2. General

2.1 These Terms govern the Auctioneer's/Developer's use of PropertyLinks.ie, including all digital tools, marketing services, and Data Rooms provided on the platform.

2.2 Please read these Terms and Conditions carefully. If you do not accept them, you must not use the Site. By accessing or using the Site, you confirm that you accept these Terms and Conditions and agree to comply with them.

2.3 We may revise these Terms and Conditions at any time by updating this page. You should review this page periodically, as the Terms and Conditions are binding on you, and each time you use the Site you are deemed to have accepted the most current version.

3. Using the Website

The use of this website is subject to the following terms of use:

3.1 All information uploaded by the Auctioneer/Developer ("Listing Content") must be accurate, lawful, and compliant with all regulatory requirements, including BER ratings, PSRA obligations, planning disclosures, marketing regulations, and consumer protection laws.

3.2 You warrant that all Listing Content is correct at the time of upload, does not infringe third party rights, is not misleading or defamatory, and complies with Irish law.

3.3 Auctioneers/Developers accept full responsibility for inaccuracies or errors in any Listing Content or uploaded documentation.

3.4 This website uses cookies to monitor browsing activity. If you consent to the use of cookies, certain personal information may be stored and may be shared with third parties where applicable.

3.5 PropertyLinks.ie accepts no liability for any losses arising from errors, omissions, or inaccuracies within materials supplied by Auctioneers/Developers.

3.6 You must not upload false, misleading, fraudulent, or incomplete information or documents.

3.7 The Site may contain links to external websites; PropertyLinks.ie is not responsible for the content of such sites.

3.8 Access to the Site may be restricted at Property Links' discretion for misuse, breach of terms, AML failures, security concerns, or compliance issues.

3.9 Auctioneers/Developers agree to indemnify PropertyLinks.ie from all claims arising from:

  • their use of the Site,
  • inaccurate Listing Content,
  • breach of these Terms,
  • infringement of third-party rights.

3.10 Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It is your responsibility to ensure that any products, services, or information available through this website meet your specific requirements. All users are strongly advised to seek independent legal advice before, during, and after using this website.

3.11 This website contains material that is owned by us or licensed to us. Such material includes, but is not limited to, the design, layout, appearance, graphics, and overall look and feel of the site. Reproduction of any part of this material is prohibited except in accordance with the copyright notice, which forms part of these Terms and Conditions.

3.12 All trademarks reproduced on this website that are not the property of, or licensed to, the operator are acknowledged on the website.

3.13 Unauthorised use of this website may give rise to a claim for damages and/or may constitute a criminal offence.

3.15 Your use of this website and any dispute arising out of such use of the website is subject to the laws of Ireland.

3.16 Discrimination in listing is not permitted, and all listings must comply with all applicable laws as regards property listings and/or accommodation advertising (including, but not limited to, the requirement to include a BER rating in the property advertisement where applicable).

3.17 You agree to hold propertylinks.ie, its affiliates, officers, directors, employees, agents, and third-party service providers harmless from, and to defend them against, any claims, costs, damages, losses, expenses, or other liabilities (including legal fees and costs) arising out of or related to the Auctioneer/Developer Content, your access to or use of propertylinks.ie, your breach of this User Agreement, and/or any infringement of the rights of any third party.

3.18 Propertylinks.ie shall not be liable for any special, consequential, indirect, incidental, punitive, reliance, or exemplary damages, whether arising in tort, contract, or under any other legal theory, resulting from or connected with this Agreement or your use of, or inability to use, propertylinks.ie. This includes, without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, even if we have been advised of the possibility of such damages.

3.19 All users further agree to release propertylinks.ie, its affiliates, third-party service providers, and their respective directors, employees, agents, and officers from all claims, demands, and damages (actual or consequential), of every kind and nature, known or unknown, disclosed or undisclosed, arising out of or in any way connected with your use of the Site.

3.20 This User Agreement constitutes the entire agreement between you and us regarding your use of propertylinks.ie and supersedes all prior or contemporaneous agreements relating to activities on the Site. We may modify this User Agreement at any time by updating it on the Site.

3.21 By continuing to use propertylinks.ie after any changes to this User Agreement are posted, you are deemed to have accepted those changes.

3.22 Propertylinks.ie will not be liable to any party for any failure or breakdown of the site.

3.23 Any indemnity given under these conditions shall extend to all actions, proceedings, claims, demands, costs and expenses whatever and howsoever incurred or suffered by the person entitled to the benefit of the indemnity. The Auctioneer and propertylinks.ie declare themselves to be a trustee of the benefit of every such indemnity for their employees, servants or agents to the extent that such indemnity is expressed to be for their benefit.

3.24 Any notice or other communication required to be given by any party using the site to another shall be in writing and shall be deemed sufficiently given if delivered by hand, sent by post, or sent electronically. In the case of a Buyer, notices shall be sent to the email address provided in the Registration Form or Register. In the case of a Seller, notices shall be sent to the address specified for the Seller and not to the Auctioneer or propertylinks.ie.

4. Website Operation

4.1 Acting as Agent

The Auctioneer and the Seller's solicitors each act as agent for the Seller unless expressly stated otherwise. Property Links is not responsible for any default, act, or omission of either of the Seller's Agents. Unless specifically stated, the Auctioneer has no authority to complete a binding contract to sell any property on behalf of the Seller.

4.2 Admission to propertylinks.ie

Propertylinks.ie reserves the absolute right, at its sole discretion, to refuse access to the website or to restrict or prohibit participation in the bidding process by any individual or entity.

4.3 Representations

Statements made by the Auctioneer/Developer or their solicitors are not the responsibility of PropertyLinks.ie, and Property Links is not obliged to verify any representation.

4.4 Data Room

Auctioneers/Developers must ensure:

  • all documents uploaded are accurate and current,
  • changes to documents are clearly highlighted,
  • no document is misleading or incomplete.

4.5 Contract Signing

Unless alternate terms have been agreed in writing, no party has authority to legally bind any other party to a contract which shall only become legally binding after the contract has been executed by the parties to the contract in accordance with its terms and the deposit specified paid either to the Auctioneer or the Seller's nominated solicitors.

4.6 Deposit Payment

Auctioneers/Developers must:

  • manage deposit requests,
  • confirm payment instructions are valid,
  • notify Property Links when deposits are received.

PropertyLinks.ie does not handle client funds.

4.7 Non-Payment, Failure to Sign or Failure to Return Contracts

If a Buyer fails to make a deposit payment for any property by the specified payment date or fails to sign or return the contracts within the period permitted, the Seller or the Auctioneer shall, in its absolute discretion and without prejudice to any other rights or remedies available, be entitled to resell the property.

4.8 Finance In Place

Property Links shall have no responsibility to assess or verify any Proof of Funds documentation posted to the Site.

5. GDPR & Data Protection

5.1 Cookie & Consent Framework

We use necessary, analytical, and functional cookies. Users may manage consent through the cookie banner. A standalone Cookie Policy applies.

5.2 Platform Rules & Security

Users must not misuse the platform, attempt to bypass security systems, or provide false information. We apply reasonable technical measures but cannot guarantee uninterrupted service.

5.3 GDPR Compliance

Property Links are committed to complying with the General Data Protection Regulation (GDPR) and all applicable Irish data protection laws. By using this website, you acknowledge that we collect and process personal data only for legitimate purposes connected to property transactions, including user registration, identity verification, anti-money-laundering compliance, communication with auctioneers, and the secure processing of deposits or booking activity. Personal data may include identification details, contact information, AML documentation, proof of funds, property-related documentation, and usage data generated through our platform.

We process personal data on lawful bases including contract performance (GDPR Article 6(1)(b)), compliance with legal obligations (GDPR Article 6(1)(c)), and our legitimate interests in fraud prevention and platform security (GDPR Article 6(1)(f)). Data may be shared with auctioneers, vendors, solicitors, payment processors, regulatory bodies, and service providers strictly as necessary to facilitate property transactions and fulfil statutory requirements.

We retain personal data only for as long as required under Irish law, including statutory limitation periods, typically up to six years for property-related records and up to five years for AML documentation. Users have GDPR rights including access, rectification, erasure, restriction, objection, and data portability. 6. Charges

6.1 Auctioneers/Developers shall pay Property Links the applicable listing fee (currently €250 + VAT per property unless otherwise agreed).

6.2 Fees fall due 10 days after a Buyer pays a deposit.

6.3 Only one fee is payable per property, even where a sale collapses and the property is resold.

6.4 Property Links may revise fees with 30 days' written notice; the revised fees apply only to new listings thereafter.

7. Liability

PropertyLinks.ie shall not be liable for:

  • consequential, indirect, or financial loss
  • business interruption
  • system downtime
  • loss of profit, goodwill, or data.

Auctioneers/Developers use the Site at their own risk.

8. Notices

Notices will be served by email or post using details provided during registration.

9. Governing Law

These Terms are governed by the laws of Ireland.
